Terms of Service
These Terms govern access to and use of xbeathouse.com and XBEATHOUSE-operated software and services, including XBEATHOUSE Social Promotion.
1. Acceptance
By accessing or using an XBEATHOUSE website, application, or service, you agree to these Terms and to applicable laws and platform rules. If you do not agree, do not use the applicable service.
2. Purpose of the services
XBEATHOUSE provides music, artist, release, promotional, and related digital content and may provide software used to manage XBEATHOUSE operations. XBEATHOUSE Social Promotion is designed to help authorized operators prepare, review, schedule, test, and publish social media content to connected accounts.
3. Authorized use
You may use the services only for lawful purposes and only with accounts, content, systems, and data that you are authorized to access or manage. You must not attempt to bypass access controls, interfere with the services, introduce malicious code, scrape restricted areas, misuse platform APIs, or use the services to violate the rights of another person or organization.
4. Social account connections
If you connect a Facebook Page, Instagram account, TikTok account, or another supported service, you represent that you have authority to authorize the connection and perform the requested actions. You remain responsible for complying with the connected platform's terms, policies, content rules, and authorization requirements.
5. Publishing controls
XBEATHOUSE Social Promotion may provide draft, approval, scheduling, dry-run, and live-publishing modes. Dry-run results are simulations and are not public posts. Live publishing should be enabled only deliberately by an authorized operator. You are responsible for reviewing captions, media, destinations, timing, rights, disclosures, and other publication details before approval or live publishing.
6. Intellectual property
Unless otherwise stated, XBEATHOUSE names, logos, website design, artwork, text, software, music-related materials, and other original content made available through the services are owned by or licensed to XBEATHOUSE and are protected by applicable intellectual-property laws. No ownership rights are transferred merely by accessing the services.
7. Content and rights
You must have all rights and permissions required for any content you upload, schedule, publish, or otherwise use through the services. You grant XBEATHOUSE only the limited rights reasonably necessary to process that content for the requested operation. These Terms do not grant XBEATHOUSE ownership of third-party content.
8. Third-party services
The services may link to or integrate with Meta, Facebook, Instagram, TikTok, Spotify, Apple Music, YouTube, and other third-party platforms. Those services are operated independently and may change, restrict, suspend, or discontinue APIs or features at any time. Your use of them remains subject to their own terms and policies.
9. Availability and changes
We may modify, suspend, or discontinue any feature when reasonably necessary for maintenance, security, legal compliance, platform changes, or product development. We do not guarantee uninterrupted or error-free availability.
10. Disclaimers
To the maximum extent permitted by applicable law, the services are provided on an “as is” and “as available” basis. XBEATHOUSE does not guarantee that every third-party platform will accept, display, distribute, promote, or preserve content or metadata exactly as submitted.
11. Limitation of liability
To the maximum extent permitted by applicable law, XBEATHOUSE will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the services, loss of access to third-party platforms, platform API changes, failed or delayed posts, or third-party actions. Nothing in these Terms excludes liability that cannot legally be excluded.
12. Suspension or termination
Access may be restricted or terminated if necessary to protect the services, comply with law or platform requirements, address misuse, or maintain security. Connected social accounts can be disconnected from the application at any time by an authorized operator.
13. Privacy
Our handling of personal information is described in the Privacy Policy. Instructions for deleting information associated with connected social accounts are available on the Data Deletion page.
14. Governing law
These Terms are governed by the applicable laws of Canada and any applicable provincial laws, without limiting mandatory rights that may apply under other laws.
15. Changes to these Terms
We may update these Terms as our services or legal obligations change. The effective date at the top of this page indicates the current version.
